I have represented commercial landlords and tenants in both state and bankruptcy courts in a wide variety of disputes involving failure to pay rent, disagreements over tenant improvement allowances, and disputes concerning non-monetary lease breaches. In the bankruptcy proceedings of insolvent tenants I have obtained orders commanding the debtor to surrender leased premises and have defended landlords in preference litigation stemming from past-due rent collected within the 90 days before the tenant’s bankruptcy petition.

- Developed and implemented litigation strategy on behalf of national retail chain whose management had notified its landlord of plans to close stores in seven shopping centers across California at the end of the year. Led team of attorneys and argued demurrers in courts across the state to defeat the landlord’s attempts to evict the client prematurely during the holiday shopping season.
- Represented commercial contractor facing eviction and loss of a below-market lease with more than a decade left on the term. Partial consideration for the rent consisted of the contractor performing construction services to build out the landlord’s portion of the space. The landlord had begun proceedings to evict the contractor after disputing the amount he owed. Case settled on favorable terms that allowed the client to remain in the premises and exercise its remaining extension options.
- Represented commercial landlords in numerous eviction disputes with 100% success rate in obtaining possession of the premises and judgments for back rent against the defaulting tenants.
