I have represented clients in complex insolvency disputes since 1995, predominantly in cases involving difficult valuation issues and often novel questions of law. Clients have included bankruptcy trustees of individual and corporate debtors in the high-technology and professional services industries, as well as creditors of companies in the commercial real estate, engineering, internet, construction, office services, and energy services industries. I am admitted to practice before the United States Bankruptcy Court for the Northern District of California, and have been appointed to the Court's 2010 Bankruptcy Dispute Resolution Program Panel.

  • Represented bankruptcy trustee in fraudulent transfer litigation stemming from a large professional services firm’s acquisition of another’s international and United States practices. Case settled on favorable terms for the bankruptcy estate after I deposed principals of both firms to establish that partners of the acquisition target knew the transaction would leave the rump firm with debts that would be beyond its ability to pay as they matured.

  • Represented bankruptcy trustee of an administratively insolvent Chapter 7 estate where the major asset was the individual debtor’s beneficial interest in a spendthrift trust. The beneficial interest was subject to judicial liens in excess of the interest's value listed on the debtor's schedules of assets and liabilities. Negotiated settlement with lien creditors and with the trustees of the spendthrift trust that enabled the bankruptcy trustee to pay all administrative expenses of the estate and distribute 13 cents on the dollar to general unsecured creditors.

  • Represented owner on a multi-million dollar 20,000 square foot luxury residential construction project in connection with custom millwork contractor’s out-of-state assignment for the benefit of creditors.  Successfully negotiated release of materials and work-in-process free of creditors’ liens, and delivery to an alternate contractor in time to prevent delays to construction schedule’s critical path

  • Negotiated numerous settlements at pennies on the dollar on behalf of creditors in preference litigation brought by bankruptcy trustees.
